US District Court receives declaration of Kenyan birth record

An affidavit, along with a copy of Barack Obama’s Kenyan birth certificate has been issued to the US District Court (Central District of California, Santa Ana Division). NOTE update at bottom of this post.

The affidavit states  that on February 19, 2009 a visit was made to Coast General Hospital in Mambosa, Kenya. The 29-year-old US citizen states he was accompanied by a natural born citizen of the Democratic Republic of Congo.

The affadavit further states that the hospital records had been sealed as the Prime Minister of Kenya Raela Odinga is Barack Obama’s cousin.

The copy of the Coast General Hospital birth certificate was acquired for a cash “consideration” to a Kenyan military officer. The expected key administrative signatures along with the embossed seal are present on the record of birth acquired.

This story, albeit short, was picked up on mainstream news and may be the news story to watch in the following days to come.

UPDATE: Sept. 9, 2009 — The hearing was conducted on Sept. 8. The courtroom was filled to capacity. The judge ordered the hearing be conducted in a larger courtroom to accommodate the crowd.

Friday prior, a late day Motion to Dismiss was issued by the Obama counsel.

There was no visible media turnout. A pending trial date of Jan 11, 2010 has been ordered.

Controversy surrounding the Obama birth certificate

The Obama ”long form” birth certificate has been in question for a long time. A large movement is  asking for his official birth record (see reasons below). Likewise, another movement is growing — saying that the first group is nuts and is wasting everyone’s time.

Lawsuits are continually being filed for proof of President Obama’s eligibility. The latest from someone in the military.

The “Vault or Long Form” certificate has been wrongly interchanged with the “Certificate of Live Birth” as proof of birth although they are two different documents.

Although I do not subscribe to either side of the debate, here are some of the alleged reasons floating around on the internet fueling the movement for the President to prove his eligibility to lead our country. (i.e. do not shoot this messenger)

Hawaiian law: [§338-17.8]  Certificates for children born out of State.  (a)  Upon application of an adult or the legal parents of a minor child, the director of health shall issue a birth certificate for such adult or minor, provided that proof has been submitted to the director of health that the legal parents of such individual while living without the Territory or State of Hawaii had declared the Territory or State of Hawaii as their legal residence for at least one year immediately preceding the birth or adoption of such child.
     (b)  Proof of legal residency shall be submitted to the director of health in any manner that the director shall deem appropriate.  The director of health may also adopt any rules pursuant to chapter 91 that he or she may deem necessary or proper to prevent fraudulent applications for birth certificates and to require any further information or proof of events necessary for completion of a birth certificate.
     (c)  The fee for each application for registration shall be established by rule adopted pursuant to chapter 91. [L 1982, c 182, §1]

Again, the mainstream press is not reporting the current events unfolding surrounding Obama’s place of birth.

Lawsuits surrounding Obama’s birth certificate continue to mount across the country. Why won’t Barry produce? Where’s the press?

The latest update on the Andy Martin lawsuit in Hawai’i has been published.

Is this a sign of the times when proof of citizenship to run the highest office in the land is dismissed by the courts? What happened to “we the people”? More importantly, why is the mainstream press not reporting these lawsuits that have been cropping up all across the country?

To date, suits have been filed in Hawaii, Washington, California, Georgia, Pennsylvania, New York, Ohio, New Jersey and Connecticut. Read about each suit here.

Yesterday, another court is added to the list of lawmakers who refuse to produce Barack 0bama’s ORIGINAL typewritten birth certificate. A requirement to become President of the United States is to be a natural born citizen.

Questions have been circulating that 0bama was not born in this country. If he was not born of this country his mother–a United States citizen-did not meet the criteria for her son to be a US citizen as she was only 18.

At best, if 0bama was born in this country, he was adopted by his Indonesian step father and was given Indonesian citizenship as a young lad. There are no records that he made efforts to regain American citizenship to date. Perhaps he even traveled on an Indonesian passport as late as the 1980’s. Read more here.

As state after state has had suits filed requesting courts to verify his qualifications to be eligible for president each has been thrown out.

To date, President Elect 0bama has not shown his eligibility. A birth certificate posted on the internet by FactCheck.org as well as the Obama campaign site has been proven to be in fact be a lie. An obvious clue was that it was not typewritten. FactCheck.Org is funded by the Annenberg Foundation. The same foundation, in fact, that Obama worked for in conjunction with William Ayers some years ago. Read more about the FactCheck documents here.

In the latest court dispute in Hawaii Andy Martin is says the Judicial system reflects “callous disregard” for the American people. Read the press release here.

Birth Certificate (part 7)

As of October 25, 2008 the lawsuit against Obama was dismissed from Philadelphia Federal Court.

Philip Berg is now immediately appealing the dismissal of his case to the United States Supreme Court.

“We the people” want our day in court.

Is this a sign of the times when proof of citizenship to run the highest office in the land is dismissed by the courts? “We the people” will be voting in ten days and will be entrusting this man to our military, our treasury, our courts — our whole infrastructure and no one is allowed to question this man’s background as defined by the Constitition of the United States for the office of President?

An excerpt from Berg:

This is a question of who has standing to uphold our Constitution. If I don’t have standing, if you don’t have standing, if your neighbor doesn’t have standing to question the eligibility of an individual to be President of the United States – the Commander-in-Chief, the most powerful person in the world – then who does?

So, anyone can just claim to be eligible for congress or the presidency without having their legal status, age or citizenship questioned.

According to Judge Surrick, we the people have no right to police the eligibility requirements under the U.S. Constitution.

What happened to ‘…Government of the people, by the people, for the people,…’ Abraham Lincoln in his Gettysburg Address 1863.

Obama & DNC Admit All Allegations of Federal Court Birth Certificate Lawsuit – Obama’s “Not” Qualified to be President

The next page of the Berg v. Obama lawsuit has just been turned. Philip Berg is turning up the heat on the Obama birth certificate lawsuit.

(Lafayette Hill, Pennsylvania – 10/21/08) – Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that Obama and tbe DNC “ADMITTED”, by way of failure to timely respond to Requests for Admissions, all of the numerous specific requests in the Federal lawsuit. Obama is “NOT QUALIFIED” to be President and therefore Obama must immediately withdraw his candidacy for President and the DNC shall substitute a qualified candidate. The case is Berg v. Obama, No. 08-cv-04083.

Berg stated that he filed Requests for Admissions on September 15, 2008 with a response by way of answer or objection had to be served within thirty [30] days. No response to the Requests for Admissions was served by way of response or objection. Thus, all of the Admissions directed to Obama and the DNC are deemed “ADMITTED.” Therefore, Obama must immediately withdraw his candidacy for President.

Including some of the allegations that Obama has admitted through failure to respond are: born in Kenya; Kenya “natural born” citizen; foreign birth was registered in the State of Hawaii; mother gave his birth in Mombosa, Kenya.

Allegations of traveling to Indonesia on an Indonesian passport on his way to Pakistan in 1981 with his Pakistan friends when Pakistan was a no travel zone at that time for American Citizens was admitted through failure to respond.

Obama  was adopted by Lolo Soetoro of Indonesia.

By failure to respond in a timely fashion, Obama has admitted he is a citizen of Indonesia; he never took the “Oath of Allegiance” to regain his U.S. Citizenship status and he is not a “natural born” United States citizen.

When cornered, instinct will resort to fight or flight. I don’t believe Obama will resort to fleeing the situation. Perhaps there will be more legal acrobatics in the next hours to come.

With the most recent lawsuit in Hawaii for proof of “natural born citizenship” it seems Obama is trying to put out fires all over the country. He announced just today that he will be traveling back to Hawaii to be by his ailing grandmothers side later this week. Can he hush the press and put the courts off for just two more weeks? Hiding?

There are currently THREE lawsuits open for Obama proof of birth records.

 

 

The Second Complaint argues that the Secretary of State of Washington has the authority and duty to certify the voters and the candidates.

Steven Marquis, a resident of Fall City WA today filed suit in Washington State Superior Court against Secretary of State Sam Reed demanding verification of Barack Obama’s citizenship status.

“To date, in this regard, Secretary of State Sam Reed has not carried out that fundamental duty,” Marques said.

Washington’s Office of the Secretary of State rejected the requests for certification. An injunction has been requested to force the office to confirm Obama’s U.S. citizenship or remove his name from Washington ballots.  Read more here

The third and most recent lawsuit is occurring in Honolulu Circuit Court – CIVIL NUMBER: 08-1-2147-10

ANDY MARTIN has filed a Complaint for Declaratory Judgment against LINDA LINGLE, in her Official capacity as Governor Of the State of Hawai’i, DR. CHIYOME FUKINO, in her official capacity as Director of the Department of Health, requesting a certified copy of Obama’s birth certificate. Read the full lawsuit article here.

Birth Certificate (Part 4)

Philip Berg filed suit against Obama in late August (prior to the Democratic National Convention) challenging the senator’s lack of “qualifications” to serve as President of the United States. There have been legal maneuverings to avoid showing the Federal Court his “vault” (original long version) Birth Certificate. Read more here.

Here is an update of information on the ongoing birth certificate lawsuit:

The plaintiff has been performing legal acrobatics to get this monkey off it’s back rather than produce the “vault” birth certificate. Currently there is a Motion for Protective Order Staying Discovery pending Decision on their Motion to Dismiss by Obama.

Philip Berg has filed a response to the Protective Order Staying Discovery stating nine points on why the defendants’ not entitled to the protective order. Included in the nine points is:

1. Defendants’ pending Motion to Dismiss does not entitle them to a Protective Order under Federal Rule of Civil Procedure 26(c) [hereinafter F.R.C.P. 26(c]; 2. Defendants have failed to show “good cause” and are therefore not entitled to a protective order under F.R.C.P. 26(c); 3. Defendants have not pointed to any legitimate privacy concerns. Defendants have failed to point out any substantiated specific examples demonstrating that disclosure will cause a defined and serious injury; 4. Plaintiff does not seek access to the requested information for any improper purpose; 5. Defendants have not shown any risk that particularly serious embarrassment will result from the requested documents; 6. The requested information is extremely important for public safety; and “Good Cause” requires a particular need for the protection sought; 7. The sharing of information will promote fairness and efficiency so as not to delay this action; 8. Barack Obama, as U.S. Senator of Illinois and the Democratic Nominee for President of the United States, is a public person, and his citizenship status is a matter of significant public concern and is subject to legitimate public scrutiny. The Democratic National Committee is a public entity and is also subject to public scrutiny; and 9. The public interest in access to the requested information under the Freedom of Information Act 5 U.S.C. § 552 is a strong factor in favor of not granting a protective order which would prevent disclosure of such information.

Birth Certificate (Part 3)

Updated information about the ongoing birth certificate lawsuit is as follows:

Berg is “Outraged” that Obama & DNC Hide Again Behind Legal Issues as their attorney files a Motion for Protective Order to “not” Answer Admissions & Production of Documents while Betraying Public in not Producing Documents proving Obama is “qualified” to be a candidate for President.

It is believed Obama is an “illegal alien” [born in Kenya]

Country is Headed to a Constitutional Crisis

(Lafayette Hill, Pennsylvania – 10/06/08) – Philip J. Berg, Esquire, the Attorney who filed suit against Barack H. Obama challenging Senator Obama’s lack of “qualifications” to serve as President of the United States, announced today that Obama and Democratic National Committee [DNC] filed a Joint Motion for Protective Order to Stay Discovery Pending a Decision on the Motion to Dismiss (which was) filed on 09/24/08.

While legal, Berg stated he is “outraged as this is another attempt to hide the truth from the public; it is obvious that documents do not exist to prove that Obama is qualified to be President.” The case is Berg v. Obama, No. 08-cv-04083.

Their joint motion indicates a concerted effort to avoid the truth by attempting to delay the judicial process, although legal, by not resolving the issue presented: that is, whether Barack Obama meets the qualifications to be President.

It is obvious that Obama was born in Kenya and does not meet the “qualifications” to be President of the United States pursuant to our United States Constitution. Obama cannot produce a certified copy of his “Vault” [original long version] Birth Certificate from Hawaii because it does not exist.

Birth Certificate (Part 2)

http://www.obamanigeria.org/ is the website advertised on this banner hung in Lagos which is the most populous urban area in Nigeria (pop. over 8 million)

It would seem, the press is also suppressing the information surrounding the ongoing  lawsuit regarding Obama’s eligibility to be a presidential contender. If you do a google search of NEWS with key words obama, lawsuit and birth certificate you will find only a small handful of obscure press releases – none by mainstream news agencies.

As I described in an earlier post dated back in late August, there is an outstanding lawsuit pending in the Philadelphia Federal Court regarding the eligibility of Barack Obama to run for President of the United States.

Copies of all filed court records and status updates regarding the lawsuit are encouraged for public scrutiny.

Requested are: (1) a certified copy of Obama’s “vault” (original long version) Birth Certificate; and (2) a certified copy of Obama’s Certificate of Citizenship; and (3) a certified copy of the Oath of Allegiance taken by Obama taken at the age of majority.

On September 25, 2008 — the week banks started to fail and the US Government stayed in session to design and pass a $700B bailout bill — Senator Obama and the Democratic National Committee filed a Motion to Dismiss the suit on the last day to file a response, for the obvious purpose of delaying Court action.

Theoretically speaking. If someone accused you of having an angel tattoo on your back why would you not just lift your shirt and show that there was no tattoo?

There is the question of Obama’s citizenship to Africa – which he now fully admits on his fight the smears website. Is that a red herring?

But… there is also the question of Barry’s citizenship to Indonesia. Barry Soetoro not only lived in Indonesia but was adopted by his Indonesian father, Lolo Soetoro. Indonesia does not recognize duel citizenship.

Article 2, Section 1 of the US Constitution states:
No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.
 
In essence, one must be a natural born citizen of the United States and at least 35 years old.

Birth Certificate (Part 1)

As I’m sure you’re aware, there has been a lawsuit filed in Philadelphia Federal Court challenging Barack Obama’s qualifications to be President. Click here  to read the entire story about the lawsuit.

A motion has been filed for an emergency temporary restraining order prohibiting Obama from running for president, and enjoining the DNC from nominating Obama as the Democratic presidential candidate.

The TRO was denied but the exhibits have been taken into evidence. The matter stands and the case remains open, allowing the subject to once again be brought forth once all parties are served.

It all revolves around Obama’s birth certificate. Click here to read more about the birth certificate allegations. In part the IsraelInsider is quoted as saying:

FactCheck itself, as a project primarily funded by the Annenberg Foundation, hardly fits the bill of being a disinterested party, especially given Obama’s four year stint as founding chair of the Chicago Annenberg Challenge, currently being investigated due to its massive withholding of papers which document the catestrophic failure of the project, including public funds wasted under Obama’s leadership, and his relations in that project with former Weather Underground terrorist Bill Ayers.

Here’s what you’re not hearing:

The news agencies who are debunking the whole idea of the fake birth certificate are basing their stories on information from a website called Factcheck.0rg.

Factcheck.0rg is owned/funded by the Annenberg Foundation.

Senator Obama was the first Chairman of the Board of the Chicago Annenberg “Challenge,” which was owned/funded by the Annenberg Foundation.

Obamas good friend, Bill Ayers was instrumental in founding the “Challenge.”

The association can hardly be deemed an unbiased source of reference.

U.S. District Judge R. Barclay Surrick has ordered the Democratic National Committee and the FEC to respond by Oct. 21 to Berg’s lawsuit.
